ALICI

gotcha.so üzerinden işbu Sözleşme’ye konu siparişi veren tüketicidir.

ALICI’ya ait ad, soyad, iletişim, teslimat ve fatura bilgileri sipariş sırasında elektronik ortamda alınır ve ilgili sipariş kaydı, sipariş özeti ve/veya faturada yer alır.

SATICI ve ALICI birlikte “Taraflar” olarak anılacaktır.

2. SÖZLEŞMENİN KONUSU

İşbu Sözleşme, ALICI’nın SATICI’ya ait internet sitesi üzerinden sipariş verdiği ürünlerin satışı, ödenmesi ve teslimine ilişkin tarafların hak ve yükümlülüklerini düzenler.

ALICI; siparişini tamamlamadan önce ürünün temel özellikleri, toplam satış bedeli, ödeme, teslimat, cayma ve iade koşulları hakkında bilgilendirildiğini kabul eder.

Sözleşme, ALICI’nın elektronik ortamda onay vermesi ve ödeme yükümlülüğü doğuran siparişi tamamlamasıyla yürürlüğe girer.

3. ÜRÜN VE SİPARİŞ BİLGİLERİ

Ürünün adı, modeli, rengi, ölçüsü, adedi, satış fiyatı, varsa indirim tutarı, kargo bedeli, ödeme yöntemi ve tahmini teslim süresi sipariş özeti ile faturada gösterilir.

Ürünün malzemesi, ölçüleri, duy tipi, önerilen ampul özellikleri ve kullanım koşulları ilgili ürün sayfasında belirtilir.

Ön Bilgilendirme Formu, sipariş özeti, ürün sayfası ve fatura bu Sözleşme’nin ayrılmaz parçalarıdır.

4. ÜRETİM ÖZELLİKLERİ

GOTCHA ürünleri 3D baskı ve benzeri katmanlı üretim yöntemleriyle hazırlanabilir.

Bu üretim yönteminin doğal sonucu olarak ürünlerde küçük katman izleri, yüzey ve doku farklılıkları, renk tonu değişiklikleri ve ölçü toleransları görülebilir.

Ürünün kullanımını, güvenliğini veya temel özelliklerini etkilemeyen küçük üretim farklılıkları ayıp sayılmaz.

Kırık, çatlak, eksik, çalışmayan, yanlış gönderilen veya ürün açıklamasındaki temel özellikleri taşımayan ürünler bakımından ALICI’nın kanuni hakları saklıdır.

Ürünün sipariş üzerine üretilmesi, tek başına kişiye özel ürün olduğu anlamına gelmez.

5. ÖDEME

Ürünün tüm vergiler dâhil toplam satış bedeli ve varsa kargo ücreti sipariş tamamlanmadan önce ALICI’ya gösterilir.

Ödemeler iyzico veya internet sitesinde sunulan diğer ödeme yöntemleri üzerinden gerçekleştirilebilir. iyzico yalnızca ödeme işlemine aracılık eder. Ürünün satışı, hazırlanması ve tesliminden SATICI sorumludur.

Ödemenin alınamaması veya iptal edilmesi hâlinde SATICI’nın ürünü hazırlama ve teslim yükümlülüğü doğmaz.

6. TESLİMAT

Standart ürünler, sipariş sırasında belirtilen süre içinde ve her hâlükârda sipariş tarihinden itibaren en geç 30 gün içinde teslim edilir.

ALICI’nın özel isteği doğrultusunda hazırlanan kişiye özel ürünler için daha uzun bir üretim ve teslim süresi belirlenebilir. Bu süre sipariş tamamlanmadan önce ALICI’ya bildirilir.

Ürün ALICI’ya veya ALICI’nın belirlediği kişiye teslim edilinceye kadar oluşabilecek kayıp ve hasarlardan SATICI sorumludur.

ALICI, teslimat ve iletişim bilgilerini doğru ve eksiksiz vermekle yükümlüdür. Yanlış adres, teslimatın kabul edilmemesi veya ALICI’nın adreste bulunmaması nedeniyle ürünün geri dönmesi hâlinde yeniden gönderim masrafı ALICI’ya ait olabilir.

Hasarlı paketler için kargo görevlisine tutanak tutturulması tavsiye edilir. Tutanak tutulmaması ALICI’nın kanuni haklarını ortadan kaldırmaz.

7. MÜCBİR SEBEPLER

Doğal afet, yangın, salgın, savaş, grev, kamu otoritesi kararları, genel ulaşım, iletişim veya enerji kesintileri gibi tarafların kontrolü dışında gelişen durumlar mücbir sebep sayılır.

Mücbir sebebin üretim veya teslimatı etkilemesi hâlinde ALICI mümkün olan en kısa sürede bilgilendirilir. Teslimatın imkânsızlaştığının öğrenilmesi hâlinde ALICI’ya en geç 3 gün içinde yazılı bildirim yapılır.

Teslimatın tamamen imkânsızlaşması hâlinde tahsil edilen ürün ve mevzuat kapsamında iade edilmesi gereken teslimat bedelleri, bildirimin yapıldığı tarihten itibaren en geç 14 gün içinde ALICI’ya iade edilir.

8. CAYMA HAKKI

ALICI, kişiye özel ürünler ve mevzuatta belirtilen diğer istisnalar dışında, ürünü teslim aldığı tarihten itibaren 14 gün içinde gerekçe göstermeden ve cezai şart ödemeden Sözleşme’den cayabilir.

Cayma hakkı, Sözleşme’nin kurulması ile ürünün teslimi arasındaki sürede de kullanılabilir.

Cayma bildirimi, SATICI’nın yukarıda belirtilen e-posta adresine veya internet sitesinde mevcutsa iade formu üzerinden yazılı olarak yapılabilir.

İndirimli veya kampanyalı ürünlerde de kanuni cayma hakkı devam eder.

9. İADE VE GERİ ÖDEME

ALICI, cayma bildiriminden itibaren ürünü en geç 14 gün içinde SATICI’ya geri göndermelidir.

İade Adresi: SATICI’nın yukarıda belirtilen adresidir.

SATICI’nın anlaşmalı bir iade kargo firması bulunmamaktadır. ALICI, ürünü göndermeden önce SATICI ile e-posta üzerinden iletişime geçmelidir.

SATICI, ALICI’ya ürünün ücretsiz olarak geri gönderilebilmesi veya teslim alınabilmesi için uygulanacak yöntemi yazılı olarak bildirir. Cayma hakkı kapsamındaki iade kargo masrafı ALICI’ya yüklenmez.

ALICI’nın SATICI’nın yönlendirmesi dışında, kendi isteğiyle farklı veya daha pahalı bir gönderim yöntemi kullanması hâlinde oluşan ilave masraflar SATICI tarafından karşılanmaz.

Ürün; kablosu, başlığı, duy sistemi, aksesuarları ve diğer parçalarıyla birlikte, taşıma sırasında zarar görmeyecek şekilde paketlenmelidir.

Ambalajın açılması veya ürünün çalışmasının makul ölçüde kontrol edilmesi tek başına iade hakkını ortadan kaldırmaz.

ALICI, cayma süresi içinde ürünü işleyişine, teknik özelliklerine ve kullanım talimatlarına uygun şekilde kullanması nedeniyle meydana gelen olağan değişiklik ve bozulmalardan sorumlu değildir. Ancak kullanımın ürünün niteliğini, özelliklerini ve işleyişini belirlemek için gerekli olanın ötesine geçmesi veya ALICI’nın kusurlu kullanımı nedeniyle üründe değer kaybı oluşması hâlinde, mevzuatın izin verdiği ölçüde bu gerçek değer kaybı ALICI’dan talep edilebilir. Buna özellikle aşağıdaki durumlar dahildir:

• kırılması, çatlaması, çizilmesi veya deforme olması;

• parçalarının kaybedilmesi veya değiştirilmesi;

• elektrik aksamının, kablosunun veya duyunun değiştirilmesi;

• uygun olmayan ampul veya elektrik bağlantısıyla kullanılması;

• kullanım talimatlarına aykırı kullanılması;

• suya, yüksek ısıya veya darbeye maruz bırakılması;

• iade sırasında yetersiz paketleme nedeniyle zarar görmesi.

SATICI, iade edilen ürünün durumunu fotoğraf, video veya inceleme tutanağıyla kayıt altına alabilir.

Ürün bedeli ve mevzuat kapsamında iade edilmesi gereken teslimat giderleri, iade edilen ürünün SATICI’ya ulaşmasından itibaren en geç 14 gün içinde, satın alma sırasında kullanılan ödeme yöntemine uygun olarak iade edilir.

10. CAYMA HAKKI OLMAYAN ÜRÜNLER

ALICI’nın özel isteğiyle standart ürün seçeneklerinin dışında hazırlanan aşağıdaki ürünlerde cayma hakkı kullanılamaz:

• Standart ölçüler dışında üretilen ürünler;

• Standart renk seçenekleri dışında özel renkte üretilen ürünler;

• İsim, yazı, logo veya kişisel tasarım eklenen ürünler;

• Tasarımı, parçaları veya elektrik sistemi ALICI’nın talebiyle değiştirilen ürünler;

• Belirli bir mekân veya projeye özel hazırlanan ürünler.

Ürünün kişiye özel olduğu sipariş tamamlanmadan önce açıkça belirtilir.

Standart model, renk veya ölçülerden birinin seçilmesi tek başına ürünü kişiye özel hâle getirmez.

Kişiye özel bir ürünün kırık, eksik, çalışmayan veya siparişe aykırı teslim edilmesi hâlinde ALICI’nın ayıplı mala ilişkin kanuni hakları devam eder.

11. AYIPLI ÜRÜNLER

Ürünün kırık, çatlak, eksik, çalışmayan, yanlış model veya yanlış renkte teslim edilmesi hâlinde ALICI durumu SATICI’ya bildirir.

ALICI, kanuni şartlar kapsamında ücretsiz onarım, ayıpsız ürünle değişim, bedel indirimi veya bedel iadesi haklarından birini kullanabilir.

Ayıplı ürünlerin geri gönderim, onarım veya değişim giderleri ALICI’ya yüklenmez.

12. KULLANIM VE GÜVENLİK

Ürün yalnızca ürün sayfasında belirtilen duy tipine ve teknik değerlere uygun LED ampulle kullanılmalıdır. Belirtilen azami watt değeri aşılmamalıdır.

Ürün, aksi belirtilmedikçe yalnızca iç mekânda kullanılmalı; sudan, yoğun nemden, yüksek ısıdan, açık alevden ve darbelerden korunmalıdır.

Elektrik aksamının değiştirilmesi, uygun olmayan ampul kullanılması veya kullanım talimatlarına aykırı kullanım nedeniyle oluşan arızalar kullanım hatası sayılabilir.

Bu hükümler, SATICI’nın ayıplı maldan ve ürün güvenliğinden doğan kanuni sorumluluğunu ortadan kaldırmaz.

13. UYUŞMAZLIKLAR VE YÜRÜRLÜK

Uyuşmazlıklarda, ilgili parasal sınırlar kapsamında ALICI’nın yerleşim yerindeki veya tüketici işleminin yapıldığı yerdeki Tüketici Hakem Heyeti’ne başvurulabilir.

Diğer uyuşmazlıklarda zorunlu arabuluculuk hükümleri saklı olmak üzere tüketici mahkemeleri görevlidir.

İşbu Sözleşme, ALICI’nın elektronik ortamda onay vermesi ve siparişi tamamlamasıyla yürürlüğe girer.

Türkçe ve İngilizce metinler arasında farklılık veya yorum ayrılığı olması hâlinde Türkçe metin esas alınır.

BUYER

The consumer who places the order subject to this Agreement through gotcha.so.

The BUYER’s name, contact details, delivery address and billing information are collected electronically during the order process and are recorded in the relevant order record, order summary and/or invoice.

The SELLER and the BUYER are hereinafter collectively referred to as the “Parties.”

2. SUBJECT OF THE AGREEMENT

This Agreement governs the rights and obligations of the parties regarding the sale, payment and delivery of the products ordered by the BUYER through the SELLER’s website.

The BUYER acknowledges that, before completing the order, the BUYER has been informed about the essential characteristics of the product, the total sales price, payment, delivery, withdrawal and return conditions.

The Agreement enters into force when the BUYER provides electronic approval and completes the order that gives rise to a payment obligation.

3. PRODUCT AND ORDER INFORMATION

The product name, model, colour, dimensions, quantity, sales price, any discount amount, shipping fee, payment method and estimated delivery time are shown in the order summary and invoice.

The product material, dimensions, socket type, recommended bulb specifications and conditions of use are stated on the relevant product page.

The Preliminary Information Form, order summary, product page and invoice form an integral part of this Agreement.

4. MANUFACTURING CHARACTERISTICS

GOTCHA products may be manufactured using 3D printing and similar additive manufacturing methods.

As a natural result of these manufacturing methods, minor layer lines, surface and texture variations, colour tone differences and dimensional tolerances may occur.

Minor manufacturing variations that do not affect the product’s use, safety or essential characteristics shall not be considered defects.

The BUYER’s statutory rights are reserved in respect of products that are broken, cracked, incomplete, non-functional, incorrectly supplied or do not possess the essential characteristics stated in the product description.

The fact that a product is made to order does not, by itself, mean that it is a personalised product.

5. PAYMENT

The total sales price of the product, including all taxes, and any shipping fee are displayed to the BUYER before the order is completed.

Payments may be made through iyzico or other payment methods offered on the website. iyzico acts solely as a payment intermediary. The SELLER is responsible for the sale, preparation and delivery of the product.

If payment cannot be collected or is cancelled, the SELLER shall have no obligation to prepare or deliver the product.

6. DELIVERY

Standard products shall be delivered within the period indicated during the order process and, in any event, no later than 30 days from the order date.

A longer production and delivery period may be set for personalised products prepared in accordance with the BUYER’s special request. This period shall be notified to the BUYER before the order is completed.

The SELLER is responsible for any loss or damage occurring until the product is delivered to the BUYER or to a person designated by the BUYER.

The BUYER is obliged to provide accurate and complete delivery and contact information. If the product is returned due to an incorrect address, refusal of delivery or the BUYER’s absence from the address, the cost of reshipment may be charged to the BUYER.

For damaged packages, the BUYER is advised to have a damage report prepared by the courier. Failure to obtain such a report does not eliminate the BUYER’s statutory rights.

7. FORCE MAJEURE

Events beyond the reasonable control of the parties, including natural disasters, fire, epidemics, war, strikes, decisions of public authorities and general transport, communication or energy interruptions, shall be considered force majeure.

If a force majeure event affects production or delivery, the BUYER shall be informed as soon as reasonably possible. If it becomes known that delivery has become impossible, the BUYER shall be notified in writing within no later than 3 days.

If delivery becomes completely impossible, the product price and any delivery costs required to be refunded under applicable law shall be refunded to the BUYER within no later than 14 days from the date of notification.

8. RIGHT OF WITHDRAWAL

Except for personalised products and other exceptions specified by applicable law, the BUYER may withdraw from the Agreement within 14 days from the date of receipt of the product, without giving any reason and without paying any penalty.

The right of withdrawal may also be exercised during the period between conclusion of the Agreement and delivery of the product.

The withdrawal notice may be submitted in writing to the SELLER’s email address stated above or, if available, through the return form on the website.

The statutory right of withdrawal also applies to discounted or promotional products.

9. RETURNS AND REFUNDS

The BUYER must return the product to the SELLER no later than 14 days after submitting the withdrawal notice.

Return Address: The SELLER’s address stated above.

The SELLER does not have a contracted return courier. The BUYER must contact the SELLER by email before sending the product.

The SELLER shall inform the BUYER in writing of the method to be used for returning the product free of charge or arranging collection. The return shipping cost within the scope of the right of withdrawal shall not be charged to the BUYER.

If the BUYER chooses a different or more expensive shipping method outside the SELLER’s instructions, any additional costs shall not be covered by the SELLER.

The product must be packaged together with its cable, shade, socket system, accessories and all other components in a manner that prevents damage during transportation.

Opening the packaging or reasonably inspecting whether the product functions does not, by itself, remove the right of return.

The BUYER shall not be responsible for ordinary changes or deterioration resulting from using the product during the withdrawal period in accordance with its functioning, technical characteristics and instructions for use. However, if use goes beyond what is necessary to establish the nature, characteristics and functioning of the product, or if loss in value results from the BUYER’s faulty use, the BUYER may be required, to the extent permitted by applicable law, to compensate the actual loss in value. This includes in particular the following circumstances:

• the product is broken, cracked, scratched or deformed;

• parts are lost or replaced;

• the electrical components, cable or socket are altered;

• the product is used with an unsuitable bulb or electrical connection;

• the product is used contrary to the instructions for use;

• the product is exposed to water, high heat or impact;

• the product is damaged due to inadequate packaging during return shipment.

The SELLER may document the condition of the returned product by photograph, video or inspection report.

The product price and any delivery costs required to be refunded under applicable law shall be refunded no later than 14 days after the returned product reaches the SELLER, using a method compatible with the payment method used for the purchase.

10. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal may not be exercised for the following products prepared outside the standard product options in accordance with the BUYER’s special request:

• products manufactured in non-standard dimensions;

• products manufactured in a custom colour outside the standard colour options;

• products to which a name, text, logo or personal design has been added;

• products whose design, parts or electrical system have been altered at the BUYER’s request;

• products prepared specifically for a particular venue or project.

The personalised nature of the product shall be clearly stated before the order is completed.

Selecting one of the standard models, colours or dimensions does not, by itself, make a product personalised.

If a personalised product is delivered broken, incomplete, non-functional or contrary to the order, the BUYER’s statutory rights relating to defective goods shall continue to apply.

11. DEFECTIVE PRODUCTS

If the product is delivered broken, cracked, incomplete, non-functional, in the wrong model or in the wrong colour, the BUYER shall notify the SELLER.

Subject to the statutory conditions, the BUYER may exercise one of the following rights: free repair, replacement with a non-defective product, reduction of the price or refund of the purchase price.

The costs of return, repair or replacement of defective products shall not be charged to the BUYER.

12. USE AND SAFETY

The product must be used only with an LED bulb compatible with the socket type and technical specifications stated on the product page. The specified maximum wattage must not be exceeded.

Unless otherwise stated, the product must be used indoors only and protected from water, excessive humidity, high heat, open flame and impact.

Malfunctions caused by alteration of the electrical components, use of an unsuitable bulb or use contrary to the instructions may be considered user error.

These provisions do not remove the SELLER’s statutory liability for defective goods or product safety.

13. DISPUTES AND ENTRY INTO FORCE

For disputes falling within the applicable monetary thresholds, an application may be made to the Consumer Arbitration Committee located in the BUYER’s place of residence or in the place where the consumer transaction was carried out.

For other disputes, consumer courts shall have jurisdiction, subject to mandatory mediation provisions.

This Agreement enters into force when the BUYER approves it electronically and completes the order.

In the event of any discrepancy or difference in interpretation between the Turkish and English texts, the Turkish text shall prevail.
